    Usually all members of the SMSF must be either trustee/s or directors of a company that is the trustee.

    We strongly recommend having a COMPANY as trustee. David Garde of The Tax Objection considers the implications of having individuals as trustees in detail in his article in SMSF Magazine and see this ATO video:

  • The name of a SMSF is usually based on family names. The ATO does not require it to be unique. The name of the SMSF will appear at Super Fund Lookup once it is registered with the ATO.
  • Use Super Fund Lookup to see if a SMSF with this name has already been established. SMSFs with a name that is already being used are permitted but are inadvisable in the same family.

    It is a requirement for registration of the SMSF as a regulated fund that the fund has fund property. It can be a chicken and egg situation as the SMSF can't be registered until it has fund property but the SMSF can't open a bank account until it has an ABN which means it needs to be registered. A solution? Earmark a small amount of money (say $10) as the initial fund property of the SMSF to be, but make sure it is recorded as a contribution of a member once the fund is set up.
